General Terms and Conditions (GTC)

Basic Provisions 

1.1 These General Terms and Conditions, effective from March 15, 2024, establish the business conditions under which Motorsport Legends a.s., located at Rohanské nábřeží 657/7, Karlín, 186 00 Prague 8, ID: 14445476, website: www.motorsportlegends.cz, (hereinafter referred to as the "Seller") will sell to the Buyer investment coins, medals, and other similar numismatic items and supplies, as well as other marketing and collectible items (books, paintings, posters, etc. - see current offerings in the e-shop), all related to F1. 

1.2 These GTC regulate the mutual rights and obligations arising in connection or based on the purchase contract made between the Seller and the Buyer through the e-shop on the website (hereinafter referred to as the "Purchase Contract"). The Seller delivers the Goods or Services according to the Purchase Contract either directly or through other suppliers/carriers. 

1.3 The Buyer acknowledges that they are obliged to provide their personal data accurately and truthfully and that they are obliged to inform the Seller without undue delay of any changes in their personal data. 

1.4 The wording of these GTC may be unilaterally changed or supplemented by the Seller, where the rights and obligations are governed by the GTC effective as of the date of the conclusion of the Purchase Contract.

Rights and Obligations of the Seller 

2.1 The Seller is obligated to process the Buyer's binding order, confirm it, and send the ordered goods to the address stated in this order, within five business days after the payment has been credited to the seller’s account. If a longer expedition period is stated in the description of the goods, this longer period is binding for orders containing such goods.

2.2 A binding order is defined as an order sent by the Buyer together with the payment of the purchase price and confirmed by the Seller. Confirmation is sent to the Buyer's email address specified in the order and includes a pro forma invoice. 

2.3 Orders are processed in the order they are received by the Seller. 

2.4 The Seller reserves the right to refuse to process orders or reduce the number of ordered items due to exceeding the total emission stated for the respective coin. The Buyer will be informed about this via an email message. 

2.5 The Seller reserves the right to refuse to process an order if the delivery address provided is obviously incorrect or fictitious. The Seller will send information about this refusal to the Buyer's email address. 

2.6 If the Buyer fails to fulfill their obligation to accept and pay for the goods ordered according to section 3.2 of these GTC, the Seller is entitled to suspend processing further orders from this Buyer or refuse them.

Rights and Obligations of the Buyer 

3.1 The Buyer in the order shall provide the correct postal address for the delivery of the ordered goods. 

3.2 The Buyer undertakes to accept the ordered goods and pay the total price for the ordered goods and any additional fees (postage, packing, cash on delivery) specified in the order.

3.3 The Buyer has the right to cancel an order made through the e-shop or by email by sending a written notification to the Seller's email address, no later than one hour after sending the order. 

3.4 The Buyer undertakes to pay the total price of the order immediately when paying online or within 10 days in case of payment by bank transfer. If the Seller does not receive payment to their account within this period, the order will be canceled by the Seller. 

3.5 Ownership of the goods passes to the Buyer upon receipt of the goods. In the case of mail order sales, ownership transfers to the Buyer upon the receipt of the goods at the place of delivery specified by the Buyer. If the Buyer damages, depreciates, or destroys the selected goods due to their fault before the transfer of ownership, they are liable for damages according to the general provisions on liability for damages.

 3.6 The Buyer acknowledges that the goods displayed and listed as available in the e-shop may not always correspond exactly to the Seller's stock levels, as the online store is not technically linked online with the Seller's warehouses or is overwhelmed with a number of orders. The execution and display of changes in goods availability on the e-shop may be delayed for these technical reasons.

3.7 The Buyer, who purchases goods from the Seller, is obliged to accept this goods within the contractually stipulated term, either through delivery services or possibly in person at the Seller's store, depending on the method of delivery chosen by the Buyer. If the Buyer fails to do so, i.e., does not accept the goods, they are in default of accepting the goods, in which case the Seller is entitled to store the goods in a manner appropriate to the circumstances. Storage of the goods is free for the first 6 months from the first request to accept the goods. The Seller is entitled to charge the Buyer reasonably incurred costs associated with the storage of the goods in the amount of CZK 5,000 (in words: five thousand Czech crowns) for each commenced month of storage of the goods by the Seller for the Buyer. The Seller is entitled to retain the goods for the Buyer until all costs incurred in storing the goods are reimbursed by the Buyer.

 3.8 In case of the Buyer's delay in accepting the goods for more than one year from the invoice date for the goods, the Seller has the right, after prior written notice, to sell the goods on the Buyer's account in a suitable manner after providing the Buyer with sufficient time to accept the goods. The Seller is authorized to sell the goods in an online auction or by direct sale to a third party, or by simply returning the goods back to the offer for sale on the e-shop.

Price

4.1 The price of goods is listed on the e-shop for each item offered.

 4.2 The listed prices include VAT for goods that are taxed according to the relevant legal regulations.

4.3 Given that sales at this internet address occur continuously, the Seller reserves the right to update the listed price within 24 hours of re-pricing the goods.

4.4 The Seller has an obligation to inform the Buyer, who has placed an order within this period for goods that have been re-priced, in the order confirmation.

 4.5 Shipping, handling, and insurance may be increased depending on the scope of the order and the destination address. Any increase must be quantified at the time of order confirmation.

4.6 The price of investment gold and silver coins, referred to as "investment coins," changes according to the movement of prices on the international markets of the respective precious metal. The Seller may update the price of these items several times a month, depending on the current situation.

4.7 Sales prices of silver investment coins include tax. Investment gold coins are completely exempt from VAT. Collectible items and other goods fall under the applicable VAT rate according to the current Czech VAT law.

Payment Terms 

5.1 The Buyer pays the Seller the price of the goods based on the executed order by online payment or transfer to the Seller's account. Further details and information regarding cash on delivery can be found HERE.

Shipping of Goods

 6.1 Goods are shipped via the shipping services of DHL Express (Czech Republic) and are fully governed by its shipping conditions. DHL Express shipping conditions can be found HERE.

Complaints Procedure

7.1 The Buyer may file and claim a complaint in one of the following ways:

 7.2 Each complaint must include the order number and a detailed description of the detected defects of the specific goods, including photo documentation showing the detected defects.

7.3 The Seller will assess the complaint and make a decision no later than 7 business days. The Seller will inform the Buyer of their conclusions and how the complaint will be settled electronically, unless agreed otherwise with the Buyer.

7.4 Complaints, including the possible elimination of defects, will be processed without undue delay within the periods mentioned above, but no later than 30 days from the date of the claim, unless the Seller notifies the Buyer of a longer period.

7.5 If the purchase involves collectible supplies such as cases, capsules, etc., the Buyer may take advantage of the option given by the Civil Code §1829 paragraph 1, which states, "The consumer has the right to withdraw from the contract within fourteen days. The period referred to in the first sentence runs from the day of the conclusion of the contract and if it concerns a) a purchase contract, from the day of receiving the goods, b) a contract, the subject of which is several types of goods or the delivery of several parts, from the day of receiving the last delivery of goods, or c) a contract, the subject of which is the regular repeated delivery of goods, from the day of receiving the first delivery of goods." In case of withdrawal from the purchase contract, the Buyer has the right to a refund of shipping and handling fees.

7.6 In the case of purchasing gold and silver coins, § 1837 paragraph b) of the Civil Code applies, which states that the consumer cannot withdraw from the contract "b) for the supply of goods or services whose price depends on fluctuations in the financial market independently of the entrepreneur's will and which may occur during the withdrawal period."

7.7 The Seller has the right, as part of assessing the claimed goods, to ask the Buyer to deliver the goods to an address (insert the address, usually the company's headquarters/call center/service center). The costs associated with transporting the claimed goods are paid by the Buyer.

7.8 In case of a justified complaint, the Buyer has the right to compensation for postage in the necessary amount. In case of an unjustified complaint, the Buyer has no right to compensation for their costs associated with handling the complaint and, at the same time, the Seller has no right to compensation for costs incurred on their side (unless it concerns repeated unreasonable complaints by the Buyer, which are clearly an abuse of the Buyer's rights, causing unnecessary costs to arise or increase on the Seller's side, whereby the Seller is entitled to issue an invoice for these unjustly incurred costs and the Buyer is obliged to pay these costs).

7.9 If a defect appears within six months from the receipt of the goods, it is assumed that the goods were defective at the time of receipt by the Buyer.

7.10 The Buyer may inquire about the progress of handling the complaint by phone, mail, or electronically.

7.11 In the event that a consumer dispute arises between the Seller and the consumer from an order and subsequent purchase on the e-shop, which cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court resolution of such a dispute to the designated entity for out-of-court resolution of consumer disputes, which is:

Change of General Terms and Conditions

8.1 The Seller is authorized to unilaterally change and supplement the General Terms and Conditions, and such revised General Terms and Conditions with the effective date will be published on the e-shop website as the current version. Previous versions of the General Terms and Conditions are accessible on the same website, always stating the date of their effectiveness.

Governing Law and Jurisdiction

10.1 These General Terms and Conditions and the e-shop are governed by the legal order of the Czech Republic.

10.2 Court jurisdiction is governed by Law No. 99/1963 Coll., in the current version – the Civil Procedure Code.

10.3 Legal relationships not expressly mentioned here are governed by Law No. 89/2012 Coll., the Civil Code.

Warranty for Quality 

11.1 A warranty for quality is provided for 24 months for goods which are collectible supplies such as cases, capsules, etc.

11.2 If a different, e.g., longer warranty is provided for specific goods, this fact is stated in the information for the specific goods.

11.3 The warranty period begins on the day the goods are received by the Buyer.

11.4 The fineness of investment coins made from precious metals (gold, silver) is guaranteed by the issuing state or by hallmark. Since their price follows the fluctuations of the financial market independently of the Seller's will, no additional warranty applies to them.

Period and Method of Receiving the Tax Document 

12.1 A tax document/pro forma invoice is issued and electronically sent to the Buyer at the moment the financial funds are credited to the Seller's account. The pro forma invoice serves as proof of payment for goods online or payment in advance to the Seller's account.

Period and Method of Returning Overpayments / Payments

13.1 The period for sending payment is individual, according to the conditions previously agreed upon.

13.2 Fees for making a non-cash transfer in the case of international payments are borne by the Buyer (are paid by the Buyer).

Additional Information

14.1 Registration: Motorsport Legends a.s., located at Rohanské nábřeží 657/7, Karlín, 186 00 Prague 8, ID: 14445476, the company is registered at the Municipal Court in Prague, under file no. B 27197.

14.2 Responsible person for the operation of the e-shop: Antonín Charouz

14.3 Operating hours for telephone communication: 9-17 hrs.

14.4 Responses to inquiries sent by email will be made within 3 business days if they relate to business cases.

14.5 Responses to general inquiries, offers, etc., will be made within an individual period depending on the nature of the correspondence.

14.6 Other documents published on the e-shop website, particularly the GDPR Information Memorandum, etc., are an integral part of these GTC.

14.7 Transactions are concluded in the Czech Republic, and the only governing law, which regulates everything from the offering of products/goods on the e-shop to payment for goods, any claims, or disputes, is governed exclusively by the legal regulations of the Czech Republic, further guided by these General Terms and Conditions and other documents that are an integral part of the operation of the Motorsport Legends e-shop, published in the section for downloadable documents. This provision applies regardless of where the Buyer wishes the goods to be delivered or from which country the Buyer originates.
